Education Law

Doherty, Wallace has experience and expertise providing legal advice and representation to educational institutions and individuals regarding all education law--from general school law to employment matters and litigation of all kinds.

Our firm understands the unique environment of schools, colleges, universities, and other educationally oriented organizations, whether public or private, large or small.  Our attorneys have successfully and vigorously represented clients in courts and before administrative agencies and arbitrators. We work closely with our clients to provide ongoing advice to help craft solutions to the challenges they face, with an emphasis on prevention and early resolution of legal problems whenever possible.

The issues that our attorneys regularly address include: student conduct and discipline matters; student and employee rights, including constitutional issues and privacy concerns; powers and duties of boards of trustees and administrators; difficult employee issues relating to evaluation and discipline, discrimination and harassment, investigation and termination; student/family and employee policy and handbook analysis and development; disability and anti-discrimination law, including duties towards students, employees, and others under the Americans with Disabilities Act (ADA) and state law; computer, technology and social media concerns; and compliance concerns with laws such as the Family Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), the Civil Rights Act of 1964 and their state counterparts.
